    we are listed as family derivative of my husband on his eb3 visa immigrant application. We have 2 daughters; my eldest is his stepdaughter (5 years old) my daughter carries her biological father's surname. i was not married to her father, hence she is illegitimate. But my husband icluded her in his ds-260 form.

    Will the consul approve my daughter's visa even if we don't have a consent from her father for her to immigrate to the us? is consent a rwquirement? I dont have contact with her father since she was 2 years old.
    I ask questions!

    If you were not married to the child's biological father and don't have any contacts with him, then it is possible that they approve her visa without asking a father's consent.
